• "Platform" refers to the F4WARD website, mobile apps, and associated services.
• "User" refers to any individual who registers or interacts with the Platform, including football players, parents, clubs, academies, scouts, coaches, agents, and other visitors and affiliates.
• "Content" refers to any material (such as photos, videos, text, or data) that users upload to or share via the Platform.

2. ELIGIBILITY

F4WARD is intended for all ages. Users of the platform who are under 16 years of age, must be registered in accordance with a parent/legal guardian, and can only use the platform with parental permissions and consent. By using the Platform, you represent and warrant that you are at least 16 years of age.

3. USER ACCOUNTS

To access certain features of the Platform, you will be required to create an account. You agree to provide accurate and complete information when registering, and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

4. USE OF THE PLATFORM

By accessing and using the Platform, you agree to the following:

• Use the Platform solely for lawful purposes, adhering to all relevant laws and regulations.
• Avoid uploading, posting, or sharing any content that is illegal, offensive, defamatory, or infringes on the rights of others.
• Refrain from impersonating others or misrepresenting your affiliation with any organization.

We reserve the right to suspend or terminate your account at our discretion if we determine that you have violated these Terms and Conditions or engaged in inappropriate behaviour.

As a user of the Platform, you may upload or share content, including photos, videos, text, or data related to your football or athlete development. By submitting content, you grant F4WARD a non-exclusive, worldwide, royalty-free license, which is sublicensable and transferable, to use, modify, reproduce, and distribute your content for the operation of the Platform.

You retain ownership of your content; however, you agree that F4WARD may utilize it to promote the Platform, analyse user engagement, and for other lawful purposes.

6. COMMUNICATION WITH USERS

By creating an account and registering to the F4WARD platform, or providing your contact details, you consent to F4WARD contacting you through email, phone, or other communication channels using the information you provided. This includes messages about Platform updates, user engagement, promotional offers (with your consent), and pathway/recruitment opportunities for football players, parents, coaches, clubs, academies, scouts, or agents.

You can opt out of marketing communications at any time by following the instructions in our emails or contacting us at [email protected]. However, you will continue to receive essential service-related communications, such as account updates and security notifications, as these are necessary for the operation of the Platform.

7. DATA PRIVACY

By using the Platform, you consent to the collection and use of your personal data as outlined in our Privacy Policy.

8. INTELLECTUAL PROPERTY

You are granted a limited, non-exclusive, and non-transferable license to access and use the Platform for personal, non-commercial purposes.

9. LIMITATION OF LIABILITY

The Platform is provided on an "as is" and "as available" basis. F4WARD makes no express or implied warranties regarding its operation, availability, or suitability for your needs. To the fullest extent permitted by law, F4WARD, its officers, employees, and affiliates will not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to:

• Loss of data or content.
• Loss of business opportunities or earnings.
• Damage to your devices or systems caused by software bugs, viruses, or malfunctions.

F4WARD's total liability for any claim related to the use of the Platform will not exceed the greater of the amount you have paid to use the Platform.

10. USER CONDUCT

By using the Platform, you agree not to:

• Upload, post, or share content that is defamatory, abusive, obscene, or harmful.
• Engage in harassment, bullying, or abusive behaviour towards other users.
• Impersonate any person or entity or falsely represent your affiliation with any person or entity.
• Interfere with or disrupt the Platform's functionality, including through the use of viruses, bots, or other malicious methods.
• Attempt to access or use another user's account without authorization.

We reserve the right to remove content or suspend/terminate your account if we believe you have violated these terms or if your actions are harmful to the Platform or its users.

11. PATHWAYS, RECRUITMENT & SCOUTING

If you are a football player, parent, coach, affiliate partner, club, academy, scout, agent, or any other interested user, you acknowledge that the Platform may facilitate a variety of pathway related opportunities. While F4WARD provides the Platform as a tool for these purposes, we do not guarantee specific outcomes, such as trials, contracts, or offers. Any interactions or agreements made through the Platform are strictly between you and the other party, and F4WARD assumes no responsibility for the outcomes.

12. THIRD-PARTY LINKS & SERVICES

The Platform may include links to third-party websites or services for your convenience. F4WARD does not endorse or assume responsibility for the content, practices, or policies of any third-party websites or services. You access these links at your own risk and are encouraged to review the terms and privacy policies of any third-party sites you visit.

13. TERMINATION

You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Platform will end immediately. We reserve the right to suspend or terminate your account at our discretion if we determine you have violated these Terms and Conditions.

14. MODIFICATIONS TO THE PLATFORM AND TERMS

PLAYERAPP LTD reserves the right to modify or discontinue the Platform or update these Terms and Conditions at any time without prior notice. Changes will be reflected by updating the "Last Updated" date at the top of these Terms. It is your responsibility to review the Terms regularly. Continued use of the Platform after changes signifies your agreement to the revised Terms.

15. GOVERNING LAW

These Terms and Conditions and any disputes arising from your use of the Platform are governed by the laws of NSW and Australia. By using the Platform, you agree that disputes will be resolved in the courts of NSW and Australia.
